親権の共同行使が困難な場合も、事案によって裁判所が必ず単独親権としなければならないことがありうると、考えております。法務省としては、施行までの間に、本改正案の趣旨が正しく理解されるよう法務省ホームページ等を利用して、適切かつ十分な周知広報に努めてまいります。

次に、家庭裁判所の体制についてお尋ねがありました。お尋ねについては、裁判所を取り巻く様々な状況を踏まえ、最高裁判所において適切に判断されるべきものであり、本改正案が成立した場合には、裁判所において適切な人事が行われるよう対応されるものと承知しており法務省としても適切かつ十分な周知広報に努めるなど、裁判所の取り組みに協力してまいります。

最後に親権者変更の手続き等についてお尋ねがありました。本改正案の施行後施行改正後の親権者変更の申し立てに関する規律が適用されますが、それにより、この利益が害されないようにする必要があります。そこで、本改正案では、親権者変更の申し立てが認められるのは、この利益のために必要がある場合に限っており、かつ、DVや虐待の場合の他、父母が共同して親権を行うことが、困難である場合には、親権者を父母双方とするよう変更することができないこととしております。

Finally, there was a question about the procedure for changing parental authority. The rules for filing a change of custody will apply after the amendment comes into force, but it is necessary to ensure that this interest is not prejudiced. Therefore, under this amendment, a petition for a change of custody may be granted only in cases where it is necessary for this benefit, and in cases of domestic violence or abuse, or in cases where it is difficult for parents to jointly exercise custody, it is not possible to change the custody to both parents.
